Pennsylvania Workers’ Compensation Benefits Overview

Pennsylvania businesses are required to carry workers’ compensation insurance. This type of insurance compensates an employee if he/she suffers a bodily injury or illness while working. Depending on the nature of your injuries, you may qualify for the following benefits:

  • Medical Benefits
    Upon obtaining workers’ compensation benefits, your employer will be responsible for paying all bills related to your current and future medical treatments arising from the injury. This includes compensation for diagnosis, treatment, and medications.
  • Disability Benefits
    You may be awarded temporary, permanent partial, or permanent total disability benefits. You will receive temporary benefits if you are injured and unable to work for more than 7 calendar days. You can receive temporary benefits for up to 90 days. Total compensation received will not exceed ⅔ of your average weekly salary.
    If you return to work after your injury or illness and can perform your job duties in a limited capacity, you may receive partial disability benefits. Partial disability benefits are paid up to 500 weeks. Total compensation received will not exceed ⅔ of your average weekly salary.
    You may receive permanent total disability benefits if you suffer a permanent injury and are unable to return to work. The amount of compensation you receive will depend on the body part that was injured.
  • Specific Loss Benefits
    Specific loss benefits compensation covers the loss of a limb, sight, or hearing. Such benefits are paid despite you being absent from work for a prolonged period.
  • Disfigurement Benefits
    Disfigurement benefits provide compensation to an employee for serious permanent, unsightly disfigurement to the head, face, or neck area. You may receive compensation for up to 275 weeks. Disfigurement benefits are negotiable. Consult with an attorney to discuss disfigurement benefits.
  • Dependency Benefits
    If your loved one passed away, you may be able to obtain dependency benefits. Dependency benefits include weekly compensation in addition to burial costs up to $3000. A financially dependent surviving spouse, dependent students under the age of 18, and physically challenged dependent children may receive dependency benefits.
